1. General. The products described in the Catalog and website are sold by Kete Microwave Electronics Co., Ltd.(“KETE” or “Seller” )subject to the terms and conditions contained in any express written contract between Seller and the Buyer. The technical data contained in products catalog and website, is furnished by solely for the use of the Buyer. Buyer shall be deemed to be acceptance to these terms and conditions hereof.
2.Prices and Term of Payment. KETE will quote for upon request. Quotations are valid for 30 days from the date provided. All prices are Ex-Works Quanzhou, China. Unless otherwise expressly stated by Seller in writing to the contrary, all prices quoted by Seller are exclusive of freight, any taxes, duties, insurance and other charges.
Term of payment shall be made by advanced wire transfer or Credit Card for samples and payment shall be made in US Dollars. Prices are subject to change without prior notice.
3. Shipping and Delivery. Title and Risk of Loss .Unless otherwise specifically stated by Seller in writing, products shall be delivered ExWorks (as defined in the latest edition of Incoterms published by the International Chamber of Commerce) at Seller’s premises. Title and risk of loss shall pass to the Buyer upon delivery by or on behalf of Seller as aforesaid. The means of transport shall be selected by the Buyer. If the Buyer does not designate the means of transport, it shall be selected by Seller. Claims for damage or loss while products are in transit must be made against the carrier. The Buyer shall have the burden of proving when damage or loss occurred.
Estimated delivery information represents KETE’s good faith estimates and KETE shall not be responsible for any delay in delivery for any reason whatsoever.
4. Changed Order and Cancellation. Orders may be changed or cancelled by Buyer only with written approval from the Seller. Buyer is liable for the actual costs and expenses for work in process and raw material committed. All orders subimitted for cancellation within 30 days of scheduled ship date will be subject to 100% cancellation cost.
5.Warranty. KETE warrants to be free from any defect in materials and workmanship for 1 year after products shipped to the original buyer. The warranty is valid only for the original Buyer. The limit of liability under this warranty is to repair or replace any products or parts at Seller’s option and shall not extend to any incidental or consequential damages there from. This warranty does not include items that have been misused, improperly applied, altered, improperly stored or improperly installed.
In keeping with our policy to improve our products, we reserve the right to change specifications without notice.
WARRANTY
Kete Microwave Electronics Co., Ltd.(Hereinafter KETE) warrants each products of its manufactures to be free from any defect in material and workmanship for a period of one year after delivery to the original buyer.The limit of liability under this warranty shall be to repair or replace any product, or part thereof, which proves to be defective after inspection by KETE. This warranty shall not apply to any KETE product that has been disassembled, modified, physically or electrically damaged, or to any product that has been subjected to conditions exceeding the applicable specifications of ratings.
KETE shall not be liable for any direct or consequential injury, loss or damages incurred through the use, or the inability or use, any KETE product.
KETE reserves the right to make design changes to any KETE product without incurring any obligations to make the same changes to previously purchased unites.
This warranty is the full extent of obligation and liability assumed by KETE with respect to any and all KETE products. KETE neither makes, nor authorizes any person to make, any other guarantee or warranty concerning KETE products.
If the unit at any time has any problems it would have to be shipped back to KETE location for warranty repair or replacement. In this case, the following procedure has to be followed:
1) A detailed default report shall be sent to sales@ketemicro.com, after evaluation by KETE’s QA department, the RMA will be assigned. Only after the RMA is assigned, then the shipment can be arranged.
2) For the shipment to come back would be paid by the buyer and once the unit has been repaired or replaced and ready to be shipped back to the buyer, KETE will pay for the shipping back to the buyer.
3) Returned units will undergo complete test and evaluation. Replacement and or/repair will be determined only after KETE has determined the cause of the failure. All parts returned are subject to evaluation charge when:
(1) The units meet full specifications and do not require repair or (2) failures due to excessive stresses caused by rough handling or overload during test or installation at the customers’ location.
4) KETE is not responsible for failures due to excessive stresses caused by rough handling or overload during test or installation at the buyer’s location, nor can KETE be responsible for damage caused by improper operation or faulty power supplies.
5) Every precaution is used at the factory to insure that every unit meets all electrical and mechanical specifications prior to shipment. Buyer, by his issuance of a purchase order or similar instrument, accepts this warranty. The applicable law of China shall be used for interpretation and adjudication of this warranty and related work order or purchase agreement.
